This Naija Spaces Terms and Conditions (“Agreement”) is entered into between Naija Spaces, a company with its principal place of business at Plot 1400 Tiamiyu Savage Street, Victoria Island, Lagos, Nigeria, hereinafter referred to as “Naija Spaces,” “Naijaspaces,” “us,” “we,” or “our,” and the user of our services, hereinafter referred to as “you,” “your,” or the “User.” This Agreement outlines the terms and conditions governing the services provided by Naija Spaces.
1. Services Provided
In consideration for the fees paid in advance, Naija Spaces agrees to host your website(s) on one or more of our servers. This service is contingent upon your compliance with the terms and conditions set forth in this Agreement and any other related agreements. The specific hosting services provided will adhere to the specifications associated with the hosting package you select during the signup process. Therefore, for the sake of clarity, the term “services” in this Agreement pertains to web hosting services provided by Naija Spaces. If you are an affiliate, it also includes services rendered in connection with our affiliate program. Throughout this Agreement, “Naija Spaces,” “us,” and “we” will refer to Naija Spaces.
2. Permission to Host Your Content
To facilitate website hosting, you must upload your content to our servers, thereby creating one or more copies of your content on our systems. By purchasing hosting services from us, you acknowledge and grant us permission, a license, to maintain these copies and make them available to internet users. You are solely responsible for providing all content and data comprising your website.
3. Personal Information
When you order our services, your personal information, including credit card details, are transmitted using Secure Socket Layer technology, this is an industry-standard for encrypting sensitive information. We are committed to safeguarding your privacy and will not sell your personal information to third parties (except a company that may acquire Naija Spaces). We will take reasonable measures to prevent your personal information from being disclosed to third parties. Naija Spaces, located at Plot 1400 Tiamiyu Savage Street, Victoria Island, Lagos, Nigeria, is the data controller as per the Data Protection Act 1998. So, by continuing to use our services, you consent to the processing of your personal data in accordance with our Privacy Policy, available at Privacy Policy. We may use your information for purposes such as internal reviews, website content improvement, and customizing web page layouts.

4. Backups
We will make all reasonable efforts to retain nightly backups. However, backups can fail, as with any data storage system. We encourage you to perform your own periodic backups or subscribe to our daily backup service. Files exceeding 40MB in size will not be backed up on our servers and may not be recoverable in the event of server failure. Naija Spaces will not be responsible for any damages to User Content, User’s website, or any malfunctions or service interruptions resulting from failures in User Content or other aspects of User’s website. You are solely responsible for creating backup copies of your website and content.
5. Acceptable Use/Illegal Activity
Naija Spaces maintains high-quality service standards and will not provide services to users engaged in:
- Hacking, including unauthorized penetration or access to computer systems or networks. Port scans, stealth scans, and fraudulent credit card “phishing” techniques are also prohibited.
- Hosting files or data that infringe on another’s copyright or intellectual property rights.
- Spamming or sending bulk unsolicited email, which includes unauthorized commercial messages or maintaining an open SMTP connection.
- Uploading or linking to content that violates another’s right of publicity or privacy.
- Distributing hate speech or other content that is obscene, abusive, libelous, or defamatory.
- Hosting, storing, or distributing child pornography. Naija Spaces will report any such content to law enforcement agencies.
- Hosting large amounts of data unrelated to your hosting account.
- Any illegal activities, including but not limited to engaging in IP scans, brute force attacks, mail bombing, and spam scripts.
6. Content
All services provided by Naija Spaces must be used for lawful purposes. You agree to indemnify and hold Naija Spaces harmless from any claims resulting from your use of our services, including but not limited to copyright or trademark infringement.
7. Unlimited Resources
Naija Spaces provides users with bandwidth, disk space, and other resources based on the plan selected during purchase. While some plans may be labeled as “Unlimited,” these resources are intended for normal use only. Excessive usage, inconsistent with typical usage patterns, is strictly prohibited. Naija Spaces reserves the right to suspend, discontinue, or delete accounts that exceed the allotted resources, which may result in degradation of service for other users.
8. INODES
The use of more than 50,000 inodes on any shared account may result in suspension. Accounts exceeding this limit will be removed from our backup system to prevent over-usage. Every file on your account consumes one inode. Users are responsible for maintaining usage within these limits to avoid suspension.
9. When the Services Will be Available
Naija Spaces strives to provide services 24/7. However, occasional unavailability may occur due to factors such as equipment malfunctions, maintenance procedures, repairs, power failures, telecommunication interruptions, network attacks, and other unforeseen occurrences. You acknowledge that occasional service unavailability is inherent to web hosting technology, and we do not guarantee uninterrupted service.
10. Guarantee
Naija Spaces offers a 30-day Money-Back Guarantee on shared hosting plans. If you cancel your account within 30 days, we will provide a refund for the remaining term, excluding setup fees and domain registration fees. Refunds are subject to a 10,000.00 registration fee charge for domain names, which you will retain ownership of. Account upgrades and dedicated server plans are non-refundable. We reserve the right to terminate accounts due to exceptional rudeness or vulgarity in communications with our staff.
11. Joining Naija Spaces
Upon signing up, your Naija Spaces account will have auto-renewal enabled, automatically charging your credit card on file for renewals. To avoid renewal, you must cancel your account 14 days prior to the renewal date. Failure to maintain an active payment method may result in account suspension or cancellation. Data deletion may occur if payment is not received within 60 days from the date of suspension.
12. Changes to Terms
This Agreement may change due to evolving business and industry dynamics. We will post any changes here, and your continued use of our services implies acceptance of the revised terms.
13. DMCA Copyright Infringement
Naija Spaces complies with the Digital Millennium Copyright Act (DMCA) and may suspend or terminate accounts of website owners found to infringe copyrights. If you believe your work has been copied in a manner constituting copyright infringement, please follow our DMCA Copyright Infringement procedure, available at DMCA Procedure.
14. Suspension/Termination of Services
Naija Spaces reserves the right to suspend or terminate services without notice in the event of a violation of any term or condition in this Agreement or if an account remains unpaid beyond the due date. Suspended accounts may require a reinstatement fee for restoration of services.
15. Refusal or Discontinuation of Service
Naija Spaces reserves the right to refuse or discontinue service to anyone at our sole discretion. We may also deny access to our servers if a user is involved in activities that could harm other servers on our network.
16. Limits on Use
Users agree that Naija Spaces may set limits on services, such as but not limited to bandwidth, disk space, and email usage, and may suspend or terminate accounts exceeding these limits.
17. Account Cancellation
You may cancel your account at any time by notifying our billing department. Cancellation requests must be received at least 14 days prior to your next billing date. You will be responsible for all charges incurred up to and including the day your account is terminated. All hosting fees are non-refundable for the remaining term of your account.
18. Account Deletion
If your account is canceled or terminated for any reason, all data on our servers will be deleted. Naija Spaces is therefore, not liable for any loss of data resulting from account deletion.
19. Disclaimer
Naija Spaces expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchant-ability, fitness for a particular purpose, and non-infringement. We make no warranty that our services will meet your requirements, or that the services will be uninterrupted, timely, secure, or error-free. Naija Spaces makes no warranty regarding any goods or services purchased or obtained through our services or any transactions entered into through our services.
20. Limitation of Liability
To the fullest extent allowed by applicable law, Naija Spaces shall not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits or revenues, or any intangible losses, whether incurred directly or indirectly. This includes damages resulting from: (a) your use or inability to use our services; (b) unauthorized access to our servers or personal information; (c) interruptions in transmission to or from our services; (d) transmission of bugs, viruses, or similar by third parties; (e) errors or omissions in content; and (f) third-party defamatory, offensive, or illegal conduct.
21. Indemnification
You agree to defend, indemnify, and hold harmless Naija Spaces, its affiliates, and their respective employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney’s fees, arising out of your use or misuse of our services.
22. Governing Law
This Agreement and any dispute arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
23. Severability
If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.
24. Entire Agreement
This Agreement constitutes the entire agreement between you and Naija Spaces, superseding any prior agreements between you and Naija Spaces.
